Samuel Mullane’s family requests no-contact order
NEWPORT - Matthew Hubeny remains in custody at the Lincoln County Jail after an early resolution conference Monday in front of Circuit Court Judge Thomas Branford.
Attorney Kathryn Benfield appeared on Hubeny’s behalf and informed the court that she has appointed an investigator and is receiving discovery. By June 29, Benfield will file a 60-day waiver, which allows the courts to hold Hubeny for another 60 days as lawyers investigate and prepare a case.
Samuel Mullane, 18, of Yachats died when he approached members of the Oregon State Police SWAT team, who were conducting surveillance at his residence on Tenmile Creek Road on May 31. Police say Mullane had a rifle in his hand as he approached, and three OSP troopers from the Roseburg and Springfield field offices each fired at least one shot, killing Mullane.
